Background & The Supreme Court's Intervention
Though the central Anand Marriage Act dates back to 1909, it originally lacked a registration mechanism. A crucial amendment passed in 2012 enabled state governments to formulate localized registration rules so Sikh couples wouldn't have to rely on alternative frameworks.
Despite the amendment, several states and Union Territories—including Sikkim—had not framed the necessary regulations. This legislative gap left Sikh couples with two restrictive choices: either forego formal registration or register their union under the Hindu Marriage Act, 1955.
The bottleneck was resolved by a landmark Supreme Court ruling in September 2025 (Amanjot Singh Chadha vs. Union of India), where the top court directed non-compliant states to plug administrative loopholes and immediately formulate their respective rules. Sikkim's upcoming June implementation directly fulfills this judicial mandate.
